{"id":2282,"date":"2024-08-17T00:13:01","date_gmt":"2024-08-16T18:43:01","guid":{"rendered":"https:\/\/expertvakil.com\/indian-kanoon\/?p=2282"},"modified":"2026-09-13T17:42:13","modified_gmt":"2026-09-13T12:12:13","slug":"bns-section-1","status":"publish","type":"post","link":"https:\/\/expertvakil.com\/indian-kanoon\/bharatiya-nyaya-sanhita-bns\/bns-section-1\/","title":{"rendered":"BNS Section 1"},"content":{"rendered":"\n<h1 id=\"h-bns-section-1-short-title-commencement-and-application\" class=\"wp-block-heading\">BNS Section 1 &#8211; Short title, commencement and application.<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"secp90366\">(1) This Act may be called the Bharatiya Nyaya Sanhita, 2023.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(2) It shall come into force on such date<sup>1<\/sup>&nbsp;as the Central Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different provisions of this Sanhita.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(3) Every person shall be liable to punishment under this Sanhita and not otherwise for every act or omission contrary to the provisions thereof, of which he shall be guilty within India.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(4) Any person liable, by any law for the time being in force in India, to be tried for an offence committed beyond India shall be dealt with according to the provisions of this Sanhita for any act committed beyond India in the same manner as if such act had been committed within India.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(5) The provisions of this Sanhita shall also apply to any offence committed by&#8211;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(a) any citizen of India in any place without and beyond India;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(b) any person on any ship or aircraft registered in India wherever it may be;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(c) any person in any place without and beyond India committing offence targeting a computer resource located in India.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Explanation.<\/em>&#8211;In this section, the word &#8220;offence&#8221; includes every act committed outside India which, if committed in India, would be punishable under this Sanhita.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">Illustration.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">A, who is a citizen of India, commits a murder in any place without and beyond India.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">He can be tried and convicted of murder in any place in India in which he may be found.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(6) Nothing in this Sanhita shall affect the provisions of any Act for punishing mutiny and desertion of officers, soldiers, sailors or airmen in the service of the Government of India or the provisions of any special or local law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">1. 1st July, 2024, except the provision of sub-section (2) of section 106,&nbsp;<em>vide<\/em>&nbsp;notification No. S.O. 850(E), dated, 23rd day of February, 2024,&nbsp;<em>see<\/em>&nbsp;Gazette of India, Extraordinary, Part II, sec. 3(ii).<br><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img decoding=\"async\" src=\"https:\/\/expertvakil.com\/indian-kanoon\/wp-content\/uploads\/2026\/08\/the-bharatiya-nyaya-sanhita-bns-section-1.jpg\" alt=\"BNS Section 1, BNS Section 1 Short Title Commencement and Application, Bharatiya Nyaya Sanhita Section 1, What is BNS Section 1, BNS 2023 Section 1, Section 1 BNS in India\"\/><\/figure>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>BNS Section 1 &#8211; Short title, commencement and application.
