{"id":2356,"date":"2024-08-17T00:24:34","date_gmt":"2024-08-16T18:54:34","guid":{"rendered":"https:\/\/expertvakil.com\/indian-kanoon\/?p=2356"},"modified":"2026-09-13T16:33:08","modified_gmt":"2026-09-13T11:03:08","slug":"bns-section-38","status":"publish","type":"post","link":"https:\/\/expertvakil.com\/indian-kanoon\/bharatiya-nyaya-sanhita-bns\/bns-section-38\/","title":{"rendered":"BNS Section 38"},"content":{"rendered":"\n<h1 id=\"h-bns-section-38-when-right-of-private-defence-of-body-extends-to-causing-death\" class=\"wp-block-heading\">BNS Section 38 &#8211; When right of private defence of body extends to causing death.<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"secp90403\">The right of private defence of the body extends, under the restrictions specified in section 37, to the voluntary causing of death or of any other harm to the assailant, if the offence which occasions the exercise of the right be of any of the descriptions hereinafter enumerated, namely:\u2014<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(a) such an assault as may reasonably cause the apprehension that death will otherwise be the consequence of such assault;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(b) such an assault as may reasonably cause the apprehension that grievous hurt will otherwise be the consequence of such assault;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(c) an assault with the intention of committing rape;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(d) an assault with the intention of gratifying unnatural lust;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(e) an assault with the intention of kidnapping or abducting;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(f) an assault with the intention of wrongfully confining a person, under circumstances which may reasonably cause him to apprehend that he will be unable to have recourse to the public authorities for his release;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">(g) an act of throwing or administering acid or an attempt to throw or administer acid which may reasonably cause the apprehension that grievous hurt will otherwise be the consequence of such act.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img decoding=\"async\" src=\"https:\/\/expertvakil.com\/indian-kanoon\/wp-content\/uploads\/2026\/08\/the-bharatiya-nyaya-sanhita-bns-section-38.jpg\" alt=\"BNS Section 38, Section 38 Bharatiya Nyaya Sanhita, right of private defence under BNS, when can self defence cause death in India, BNS Section 38 explained, private defence causing death law India\"\/><\/figure>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>BNS Section 38 &#8211; When right of private defence of body extends to causing death.
